The indictment says it occurred during the commission of an unlawful act not amounting to a felony, but a third-degree assault, according to the Dothan Eagle.

It was previously reported by multiple media outlets, that Emily “Emmy” Grace Noel Schrad, age 4, of Brantley, died on Aug. 4, at a Birmingham hospital after she was airlifted from Medical Center Enterprise where she had been admitted on Aug. 1 for a head injury.

An Aug. 9, 2011 obituary published in The Luverne Journal lists Schrad as Emmy’s father.

If convicted Schrad could face eight years in federal prison, three years supervised release and a fine of not more than $250,000 and restitution to the victim’s family.
