A woman is currently being held at the Butler County Correctional facility after her newborn baby tested positive for cocaine, according to Sheriff Kenny Harden.

Harden said that Joy Horton, 33, was arrested and charged with chemical endangerment of a child, a class C felony on Jan. 13, 6 days after her baby was born.

According to the Alabama Criminal Code, a person has committed chemical endangerment of a child if he or she knowingly, recklessly, or intentionally causes or permits a child to be exposed to, to ingest or inhale, or to have contact with a controlled substance, chemical substance, or drug paraphernalia.

Harden said that the Butler County Sheriff’s Department, Department of Human Resources and the District Attorney are all working on the case.

“This baby never had a choice,” Harden said.

As of Friday afternoon, Harden said that no bond had been set.
